Terms of Use and Conditions of Sale
These Terms of Use and Conditions of Sale govern purchases made through the Ada Johanna online store.
The seller and service provider is Ada Johanna OÜ, registry code 16451383 (hereinafter the Service Provider). A customer who places an order through the Ada Johanna online store and provides the personal information required to complete the order is hereinafter referred to as the Customer.
1. ONLINE STORE
1.1. The Ada Johanna online store (hereinafter the Online Store) is operated by the Service Provider and enables Customers to purchase products offered by Ada Johanna OÜ.
2. GENERAL PROVISIONS
2.1. The relationship between the Service Provider and the Customer is governed by these Terms and by the applicable laws of the Republic of Estonia, including the Law of Obligations Act.
2.2. The Service Provider may make changes to the services and functionality offered through the Online Store.
2.3. The Service Provider may amend these Terms from time to time. Amendments apply to orders placed after the amended Terms have entered into effect and do not alter the terms applicable to orders already concluded.
3. PRODUCTS AND PLACING AN ORDER
3.1. Products displayed in the Online Store are normally available in stock. Product availability may occasionally change, including as a result of technical errors or simultaneous orders.
3.2. If an ordered product is unavailable and the order cannot be fulfilled, the Service Provider will contact the Customer and offer, where appropriate, a new estimated delivery date, an equivalent replacement product of comparable price and quality, or a refund. If the Customer chooses a refund, the amount paid will be returned without undue delay.
3.3. Product images are illustrative and minor differences in appearance may occur. Every reasonable effort is made to ensure that product descriptions and other information displayed in the Online Store are accurate.
3.4. Products in the Online Store are sold to both private individuals and legal entities. Statutory consumer rights apply only where the purchaser qualifies as a consumer under applicable law.
3.5. The Customer selects the desired products, provides the information required to fulfil the order, including their first and last name, telephone number, email address and delivery address, and pays for the order using one of the payment methods offered in the Online Store.
3.6. The Customer must provide accurate information necessary for fulfilment of the order. The Service Provider is not responsible for delays or failure to fulfil an order resulting from incorrect information supplied by the Customer.
3.7. A sales contract is concluded when the Customer has submitted the order through the Online Store and payment has been successfully completed.
3.8. Payment can be made using the payment methods displayed at checkout, including supported bank links and payment cards. Payment services are provided by Maksekeskus AS.
4. PRICES
4.1. All prices displayed in the Online Store are in euros.
4.2. The Service Provider may change the prices displayed in the Online Store at any time. Changes made after an order has been placed and paid for do not affect that order. The products will be supplied at the price applicable at the time the order was placed.
5. DELIVERY
5.1. No delivery fee is charged for orders over €35 delivered to a SmartPost parcel machine.
5.2. Delivery charges are added to the purchase price according to the delivery method selected by the Customer:
- SmartPost parcel machine: €2.50
- Courier delivery: €4.90
5.3. The usual delivery time is 1–3 working days.
5.4. The Online Store is not responsible for a delivery delay where the goods have been handed over to the carrier on time and the delay is caused by circumstances beyond the reasonable control of the Online Store.
6. RIGHT OF WITHDRAWAL AND RETURNS
6.1. A consumer has the right to withdraw from a distance contract concluded through the Online Store within 14 days of receiving the goods, unless an exception provided by law applies.
6.2. The consumer may examine the goods to the extent necessary to establish their nature, characteristics and functioning. If the goods have been handled beyond what would normally be permitted when examining them in a physical shop, the consumer may be liable for any resulting reduction in value. The absence of the original packaging or limited use of the product does not in itself automatically remove the statutory right of withdrawal.
6.3. To exercise the right of withdrawal, the consumer must send an unambiguous notice of withdrawal to info@adajohanna.ee or use another withdrawal method made available by the Online Store.
6.4. After notifying the Service Provider of the withdrawal, the consumer must return the goods without undue delay and no later than 14 days after submitting the notice of withdrawal.
6.5. The Service Provider will refund payments received from the consumer, including the cost of standard delivery to the consumer where required by law, without undue delay and no later than 14 days after receiving the withdrawal notice. The Service Provider may, where permitted by law, withhold the refund until the returned goods have been received or the consumer has provided evidence that the goods have been sent back.
6.6. Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed with the consumer.
6.7. The consumer bears the direct cost of returning the goods where the consumer has been informed of this obligation before placing the order. Ada Johanna limits the Customer's return cost under these Terms to €5, unless the return is due to an incorrect or defective product or the Service Provider has agreed to bear the return cost.
Under Estonian consumer guidance, the consumer can be required to bear the direct return cost only when this has been communicated as part of the pre-contract information.
6.8. If the returned product has diminished in value because it has been handled beyond what was necessary to establish its nature, characteristics and functioning, the Service Provider may claim compensation for the corresponding reduction in value in accordance with applicable law.
The statutory right of withdrawal does not apply in cases provided by law, including certain sealed goods that are unsuitable for return for health protection or hygiene reasons once the seal has been opened after delivery.
Defective or Incorrect Products
If a product is defective, does not conform to the contract or an incorrect product has been delivered, the Customer should contact the Service Provider at info@adajohanna.ee or by telephone at +372 5344 4903.
A consumer may submit a complaint concerning a lack of conformity that becomes apparent within the statutory period. Under current Estonian consumer rules, the seller is responsible for lack of conformity for two years after delivery of the goods.
Where a manufacturing defect is established, the applicable statutory remedies include repair or replacement and, where the legal requirements are met, withdrawal from the contract and a refund.
7. DISPUTE RESOLUTION
7.1. Any disputes arising from these Terms should first be resolved through negotiations between the Customer and the Service Provider.
If the parties are unable to reach an agreement, a consumer may use the dispute resolution mechanisms available under Estonian law, including the Consumer Disputes Committee (Tarbijavaidluste komisjon), or bring the matter before a competent court. Court jurisdiction is determined in accordance with applicable law.
8. ACCEPTANCE OF THE TERMS
8.1. The Customer should read these Terms before placing an order.
8.2. By placing an order and selecting the checkbox confirming acceptance of the Online Store's terms and conditions, the Customer confirms that they have read, understood and agreed to these Terms.
9. SAFETY
The Customer must carefully follow all instructions for use and safety information provided on the website and supplied with the product.
The Service Provider is not responsible for damage resulting from use of a product contrary to its intended purpose, failure to follow the supplied instructions or safety requirements, or use of the product after its applicable expiry or recommended use period.
Candle Safety
Always follow the safety instructions when using candles. Safety pictograms and instructions for use are also provided on the bottom of the candle container.
Before lighting and while burning, keep the wick trimmed to approximately 5 mm and free from carbon build-up.
If the candle produces soot or the flame becomes excessively large, the wick may be too long or have accumulated carbon deposits. Extinguish the candle, allow it to cool and trim the wick before relighting.
Do not burn the candle continuously for more than 3 hours.
Before relighting, trim the wick to approximately 5 mm.
Place a burning candle on a stable, heat-resistant surface and keep it away from flammable materials.
Take care when moving a candle that has been burning, as the container may be hot.
Keep burning candles out of the reach of children and pets.
Keep candles away from draughts.
Never leave a burning candle unattended.
